style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">一、用人单位(甲方)确定招用劳动者(乙方)后,需签订本合同明确双方的劳动权利和义务。乙方口头同意被录用而不愿签订本合同的,甲方应作不同意招用处理;乙方同意签订合同而甲方自用工之日起超过一个月不满一年未与乙方订立书面劳动合同的,应当向乙方每月支付两倍的工资;甲方自用工之日起满一年不与乙方订立书面劳动合同的,视为甲方与乙方已订立无固定期限劳动合同。</span></p> 甲方安排乙方所从事的工作内容及要求,应当符合国家法律法规规定的劳动基准和甲方依法制订的并已公示的规章制度。乙方应当按照甲方安排的工作内容及要求履行劳动义务。</span></p> <p class="Normal"><span 甲方因工作需要,需要调整乙方工作岗位、变更工作内容时,按照合理、诚信、协商的原则,可依法变更乙方工作岗位或工作内容。但双方应签订补充协议书加以确认,该协议书将作为本合同的附件。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)综合计算工时工作制,即甲方经劳动行政部门批准,乙方所在岗位以 (周/月/季/年)为计算周期,综合总工时符合国家规定。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第七条 在实行标准工时工作制和综合计算工时工作制的情况下,因生产工作需要,甲方经与本单位工会和乙方协商后,可以安排乙方加班工作,加班总时数符合国家规定,并依法给予乙方补休或支付加班加点工资。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第八条 甲方依据国家和我省企业职工假期待遇相关规定,每年适当安排乙方休节日假、年假、婚假、产假、丧假等带薪假期。</span></p> <p class="Normal"><span 甲方依法为乙方安排带薪年休假,具体休假时间双方协商决定。</span></p> <p class="Heading-3"><span 合同期内,甲乙双方依法参加社会保险,按时缴纳各项社会保险费,其中依法应由乙方缴纳的部分,由甲方从乙方工资报酬中代扣代缴。</span></p> <p class="Normal"><span 甲方按国家有关劳动保护规定,包括女职工、未成年工的劳动保护规定和标准,为乙方提供符合国家规定的劳动保护设施和劳动条件。</span></p> <p class="Normal"><span 甲方对可能产生职业病危害的岗位,应当向乙方履行如实告知的义务,并对乙方进行劳动安全卫生教育,防止劳动过程中的伤亡事故,减少职业病危害。甲方安排乙方从事有职业危害作业的,应定期为乙方进行健康检查,并在乙方离职前进行职业健康检查。</span></p> <p class="Normal"><span 甲方按国家先培训、后上岗的规定,对乙方进行安全、卫生、职业病防护知识、法规教育和操作规程培训及其他业务技术培训;乙方应参加上述培训并须自觉遵守和执行甲方的安全卫生操作规程和职业病防护措施,进行生产和工作。</span></p> <p class="Normal"><span 乙方有权拒绝甲方的违章指挥及强令冒险作业,对甲方及其管理人员漠视乙方安全和健康的行为,有权要求改正并向有关部门检举、控告。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">七、服务期和竞业限制</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十三条 如甲方提供专项培训费用对乙方进行专业技术培训的,可以补充订立培训协议为本合同的附件,约定服务期和违约金。乙方若违反《培训服务协议》约定,提前解除劳动合同的,应偿付甲方已支出的全部培训费用(具体数额以支出的与培训有关的费用为准),对已履行部分服务期的,按照服务期尚未履行部分所应分摊的培训费用偿付。具体服务期、赔偿标准执行双方签订的《培训服务协议》。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十四条 如乙方掌握甲方的商业秘密和与知识产权相关的保密事项,乙方负有保密义务。双方可以签订竞业限制协议作为本合同的附件,约定竞业限制的范围、地域、期限、限制期内按月经济补偿的金额、违约金等事项,但竞业限制的约定不得违反法律、法规的规定。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">八、劳动合同的变更、解除和终止</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十五条 甲乙双方经协商一致,可以变更本合同,并签订书面变更协议。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十六条 经甲乙双方协商一致,本合同可以解除。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十七条 乙方提前三十日以书面形式通知甲方,可以解除劳动合同(双方签订服务期协议的,依照服务期协议的约定执行)。乙方在试用期内提前三日通知甲方,可以解除劳动合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十八条 甲方有下列情形之一的,乙方可以随时通知甲方解除劳动合同:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(1)未按照劳动合同约定提供劳动保护和劳动条件的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(2)连续2个月以上不支付或未足额支付乙方工资的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)未依法(含缴费基数低于法定标准)为乙方缴纳各项社会保险费的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(4)甲方的规章制度违反法律、法规的规定,损害乙方权益的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(5)法规、行政法规规定劳动者可以解除劳动合同的其他情形。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">甲方有以暴力、威胁或有非法限制乙方人身自由,强迫劳动的,或者甲方违章指挥、强令冒险作业危及乙方人身安全的,乙方可以立即解除劳动合同,不需事先通知甲方。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十九条 乙方有下列情形之一的,甲方可以随时通知乙方解除劳动合同:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(1)试用期内被证明不符合录用条件;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(2)严重违反用人单位规章制度或屡次违反劳动纪律、厂纪厂规屡教不改的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)严重失职、营私舞弊,给甲方造成重大损失的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(4)乙方同时与其他用人单位建立劳动关系,对完成本单位工作任务造成严重影响,或者经甲方提出,拒不改正的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(5)被依法追究刑事责任的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十条 有下列情形之一的,甲方应提前30日以书面形式通知乙方 或者额外支付乙方一个月工资后,可以解除劳动合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(1)乙方患病或非因工负伤的医疗期满,不能从事原工作也不能从事另行安排工作的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(2)乙方不能胜任工作,经过培训或调整工作岗位仍不能胜任工作的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,经甲方与乙方协商,未能就变更劳动合同达成协议的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十一条 有下列情形之一的,甲方可以裁员:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(1)甲方依照企业破产法进行重整的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(2)生产经营发生严重困难的</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)企业转产、重大技术革新或者经营方式调整,经变更劳动合同后仍需裁减人员的</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(4)其他因劳动合同订立时所依据的客观经济情况发生重大变化,致使劳动合同无法履行的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">裁减人员二十人以上或者裁减不足二十人但占企业职工总数百分之十以上的,甲方应提前三十日向工会或者全体职工说明情况,听取工会或者职工的意见后,裁减人员方案经向劳动行政部门报告,可以裁减人员。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十二条 有下列情形之一的(因乙方严重违法、违纪等原因被解除劳动合同的除外),甲方不得解除本合同:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(1)乙方从事接触职业病危害作业未进行离岗前职业健康检查,或者疑似职业病病人在诊断或者医学观察期间的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(2)乙方在甲方单位患职业病或因工负伤,经劳动鉴定委员会确认已丧失或者部分丧失劳动能力的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)乙方患职业病或非因工负伤,在规定的医疗期内的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(4)女职工在孕期、产期、哺乳期内的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(5)乙方在本单位连续工作满15年,且距法定退休年龄不足5年的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(6)法律、行政法规规定的其他情形。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十三条 有下列情形之一的,本合同即行终止:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(1)本合同期满;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(2)甲方被依法宣告破产、吊销营业执照、责令关闭、撤销或者决定提前解散的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(3)乙方开始依法享受基本养老保险待遇的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(4)乙方死亡,或者被人民法院宣告死亡或宣告失踪的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(5)法律、行政法规规定的其他情形。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十四条 本合同期满,但乙方有本合同第三十二条规定情形之一的,甲方不得与其终止劳动合同,劳动合同应当续延至相应的情形消失时终止。但是,乙方具备本合同第三十二条第二项规定情形的,按照《工伤保险条例》及有关规定执行。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十五条  有下列情形之一的,甲方应当向乙方支付经济补偿:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)甲方依据本合同第二十六条规定向乙方提出解除劳动合同并与乙方协商一致解除劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)乙方依据本合同第二十八条规定解除劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)甲方依照本合同第三十条、第三十一条第一款规定解除劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)除甲方维持或者提高劳动合同约定条件续订劳动合同,劳动者不同意续订的情形外,依照本合同第三十三条第一项规定终止固定期限劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)依照本合同第三十三条第二项规定终止劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(六)法律、行政法规规定的其他情形。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十六条 经济补偿金按乙方在本单位工作的年限,每满1年支付1个月工资,6个月以上不满1年的按1年计算,不满6个月的,支付半个月工资。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">乙方月工资高于本市上年度职工社平月工资3倍的,经济补偿金按该社平月工资3倍限额支付,并且经济补偿年限最高不超过12年。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十七条 确定解除或终止本合同时,甲方需出具《解除/终止劳动合同证明书》给乙方,并在15日内为乙方办理档案和社会保险转移手续。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十八条 乙方应当按照双方约定,办理工作交接。甲方依照本合同有关规定应当向劳动者支付经济补偿的,在办结工作交接时支付。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">九、违反合同责任</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十九条 一方违反合同,给对方造成经济损失的,应根据其后果承担赔偿责任。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">十、劳动争议处理</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十条 甲乙双方因履行本合同发生劳动争议,可以协商解决,也可以向本单位劳动争议调解委员会申请调解;协商、调解不成或不愿协商、调解的,可在法定期限内直接向劳动人事争议仲裁委员会申请仲裁。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">十一、其他</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十一条 本合同未尽事宜,按国家、省、市有关规定办理。在合同期内,如本合同条款与国家、省、市有关劳动法律、法规及政策相抵触的,按法律、法规及政策执行。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十二条 本合同一式</span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">份(两份/三份),具有同等法律效力,经双方签字或盖章后生效,甲乙双方各自保存一份。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十三条 甲方依法制定的规章制度(包括但不限于员工手册、岗位职责、培训协议、保密协议、安全准则等,在本合同签订前已送达给乙方或由乙方已经完全阅知)均属合同的附件,其效力与合同条款相同,如有冲突,则以制定时间在后者为准。</span></p> <p class="Normal"><span <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)乙方应自觉遵守甲方的职业卫生管理制度和操作规程,正确使用维护职业病防护设施和个人职业病防护用品,积极参加职业卫生知识培训,按要求参加上岗前、在岗期间和离岗时的职业健康检查。若被检查出职业禁忌证或发现与所从事的职业相关的健康损害的,必须服从甲方为保护乙方职业健康而调离原岗位并妥善安置的工作安排。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)当乙方工作岗位或者工作内容发生变更,从事告知书中未告知的存在职业病危害的作业时,甲方应与其协商变更告知书相关内容,重新签订职业病危害告知书。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)甲方未履行职业病危害告知义务,乙方有权拒绝从事存在职业病危害的作业,甲方不得因此解除与乙方所订立的劳动合同。</span></p>
