1、依法制订有关治安、消防、卫生、用电、营业时间等内容的各项规章制度并负责监督实施。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  2、协助各级行政管理机关对违反有关规定的乙方进行监督、教育、整顿。</span></p> <p class="Normal" 3、应按约定为乙方提供场地及相关配套设施和经营条件,保障乙方正常经营。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  4、除有明确约定外,不得干涉乙方正常的经营活动。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  5、应对市场进行商业管理,维护并改善市场的整体形象,包括:对商品品种的规划和控制、功能区域的划分、商品档次的定位、商品经营的管理及质量管理;服务质量管理;营销管理;形象设计;市场调研;公共关系协调;纠纷调解;人员培训;▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  6、应对市场进行物业管理,并负责市场内的安全防范和经营设施的建设及维护,包括:建筑物(包括公共区域及租赁场地)的管理及维修保养;对乙方装修的审查和监督;水、电、气、空调、电梯、扶梯等设备、管道、线路、设施及系统的管理、维修及保养;清洁管理;保安管理并负责市场的公共安全;消防管理;内外各种通道、道路、停车场的管理;▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  7、做好市场的整体广告宣传,并保证每年广告宣传费用不低于市场当年租金总额的▁▁▁%。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span 1、有权监督甲方履行合同约定的各项义务。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  2、应具备合法的经营资格,并按照工商行政管理部门核准的经营范围依法亮证照经营。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  3、应自觉遵守甲方依法制订的各项规章制度及索票索证制度,服从甲方的监督管理。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  4、应按期支付租金并承担因经营产生的各项税费。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  5、应爱护并合理使用市场内的各项设施,如需改动应先征得甲方同意,造成损坏的还应承担修复或赔偿责任。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  6、应按照约定的用途,本着公平合理、诚实信用的原则依法经营,不得损害国家利益及其他经营者和消费者的合法权益,并承担因违法经营造成的一切后果。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  7、将场地转让给第三人或和其他租户交换场地的,应先征得甲方的书面同意,按规定办理相关手续,并不得出租、转让、转借营业执照。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  8、应按照甲方的要求提供有关本人或本企业的备案资料。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  9、建筑物外立面及建筑物内部非乙方承租场地范围内的广告发布权归甲方所有,未经甲方同意,乙方不得以任何形式在上述范围内进行广告宣传。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 合同的解除</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  乙方有下列情形之一的,甲方有权解除合同,乙方应按照▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁的标准支付违约金:</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  1、在租赁期限内因违法经营被有关行政管理部门吊销、收回经营证照的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  2、未按照约定的用途使用场地,经甲方▁▁▁次书面通知未改正的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  3、利用场地加工、销售假冒伪劣商品的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  4、进行其他违法活动累计达▁▁次或被新闻媒体曝光造成恶劣影响的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  5、将场地擅自转租、转让、转借给第三人,或和其他租户交换场地的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  6、逾期▁▁▁日未支付租金或水电、▁▁▁▁▁▁等费用的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  7、违反保证金协议的有关约定的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  8、未经甲方同意连续▁▁▁日未开展经营活动的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  9、违反甲方依法制订的规章制度情节严重或拒不服从甲方管理的。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  ▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁▁。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  甲方或乙方因自身原因需提前解除合同的,应提前▁▁▁日书面通知对方,经协商一致后办理解除租赁手续,并按照▁▁▁▁▁▁▁▁▁▁▁▁▁的标准向对方支付违约金。因甲方自身原因提前解除合同的,除按约定支付违约金外,还应减收相应的租金,并退还保证金及利息。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:bold;">  第九条 </span><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;"> 其他违约责任</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span style="color:#000000;font-size:12.5pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;font-weight:normal;">  1、甲方未按约定提供场地或用水、用电等市场内的经营设施或条件致使乙方不能正常经营的,应减收相应租金,乙方有权要求甲方继续履行合同或解除合同,并要求甲方赔偿相应的损失。</span></p> <p class="Normal" style="text-align:left;line-height:22.0pt;"><span
