总则</span><span <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第一条 职工一方和公司(国有、集体及其控股以外的企业),为维护职工和公司的合法权益、促进公司发展和职工利益的提高,构建和谐稳定的劳动关系,根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《中华人民共和国工会法》、《北京市集体合同条例》及相关法律、法规,经协商一致,签订本合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二条 本合同确立劳动报酬、工作时间、休息休假、劳动安全卫生、职业培训、保险福利等各项劳动标准和劳动条件。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三条 本合同对公司和本公司的全体职工具有法律约束力。</span><span style="color:#000000;font-size:12.0pt;font-family:SimSun;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">&nbsp;&nbsp;&nbsp;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四条 公司依法经营,认真履行本合同,尊重并支持工会工作,积极落实《企业工会工作条例》,依法按时足额拨缴工会经费,保证工会各项工作的开展。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五条 工会维护职工的合法权益,协调劳动关系,组织职工参与公司的民主管理、民主监督。工会教育职工自觉遵守公司各项规章制度、劳动纪律;爱护公司财产,保守公司秘密,爱岗敬业;认真履行劳动合同、集体合同,恪尽职守;自觉执行经职工代表大会或职工大会审议通过的重大决策和决议;立足本职,尽职尽责。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">第二章 劳动合同管理</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第六条 劳动合同制度</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司依法建立劳动合同制度,规范劳动用工行为,与工会协商加强劳动合同管理。工会应当帮助、指导职工与公司依法订立和履行劳动合同,并对公司劳动合同制度实施情况进行监督。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第七条 招聘职工</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司需要招录职工,按照公开、公正、公平、合理、择优录取的原则,依据招聘条件录用职工。公司在制定招聘条件时,应详细、具体、量化、具有可操作性,并告知工会,便于公司招聘职工、考核试用期职工。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司在制定招聘条件、招收录用职工时,不能因为性别、民族、信仰、宗教、婚姻、年龄等因素的影响而出现就业歧视的现象。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第八条 用工形式</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)本公司全日制职工。公司与建立劳动关系的所有人员签订劳动合同,并依据劳动合同确定的工作岗位、工作内容、工作时间、工作标准等安排职工工作。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)劳务派遣职工。公司通过与劳务派遣公司签订协议,招用劳务派遣人员在一些临时性、辅助性或者替代性的工作岗位上工作。公司长期性的工作岗位不适宜招用劳务派遣职工。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)非全日制职工。公司针对季节性、临时性、辅助性的工作,可以招用非全日制职工,双方可以订立口头协议。非全日制职工以小时计算劳动报酬。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第九条  试用期</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)试用期限:劳动合同期限3个月以上不满1年的,试用期不得超过1个月;劳动合同期限1年以上不满3年的,试用期不得超过2个月;3年以上固定期限和无固定期限的劳动合同,试用期不得超过6个月。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)试用期职工因事假、病假等原因超过 天休息的,需延长相应天数的试用期。本公司全日制职工经过试用期后,其工龄从录用日期算起。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)公司在试用期解除职工劳动合同的,应至少在解聘前</span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;text-decoration: underline;">    </span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">天通知该职工,并书面说明理由。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)试用期职工除特殊说明外,享受本协议规定的其它相关福利待遇。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十条 劳动合同期限</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司根据工作岗位、工作要求、工作性质确定劳动合同期限,分为固定期限、无固定期限和以完成一定工作为期限三种。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">职工获得市级以上劳动模范、先进工作者称号的,当其提出签订无固定期限劳动合同时,应当订立无固定期限劳动合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十一条 劳动合同的订立</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)公司制定和修改劳动合同时,当事人双方应当就劳动合同的具体内容进行协商,并听取工会的意见。劳动合同文本应当提交职工代表大会或职工大会讨论。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)公司与女职工签订的劳动合同中不得规定限制女职工结婚、生育等内容。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十二条 劳动合同的变更</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司与职工协商一致,可以变更劳动合同约定的内容,并采用书面形式记载,经双方签字或盖章生效。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">工会应当监督变更劳动合同程序的合法性,帮助职工了解劳动合同变更的实质内容及今后可能产生的影响。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十三条 劳动合同的解除</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)公司需要裁减人员20人以上或者裁减不足20人但占公司职工总数10%以上的,应当事先将理由通知工会。工会认为不适当的,有权提出意见。公司违反法律、法规规定或者劳动合同约定的,工会有权要求公司纠正。公司应当研究工会的意见,并将处理结果书面通知工会。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)享受医疗期的职工,医疗期满仍未病愈的,应由北京市劳动能力鉴定委员会进行劳动能力鉴定。被鉴定为一至四级的,应当退出劳动岗位,解除劳动合同,办理因病或非因工负伤病退、退职、退休手续;被鉴定为五至十级的,公司可以解除劳动合同,并按规定支付经济补偿金和医疗补助费。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)公司裁减人员时,应优先留用下列人员:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">1.获得市级以上劳动模范、先进工作者称号的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">2.订立无固定期限劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">3.订立较长期限的固定期限劳动合同的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">4.家庭无其他就业人员,有需要扶养的老人或者未成年人的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">5.公司特困职工、困难职工。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)工会应当监督公司解除劳动合同的行为,保证解除程序合法、解除理由充分、职工有申诉的权利。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)职工申请辞职或要求解除劳动合同,需提前一个月以书面形式提出,办好交接手续后即可解除劳动合同。职工在试用期内要求解除劳动合同,需提前三天向公司提出,即可解除劳动合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十四条 其它约定</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)公司订立、履行、变更、解除、终止以及续订劳动合同,应当遵循法律、法规和本合同的有关规定,当事人双方应就劳动合同具体内容进行平等协商。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)公司工会专职主席、副主席或者委员自任职之日起,其劳动合同期限自动延长,延长期限相当于其任职期间;非专职主席、副主席或者委员自任职之日起,其尚未履行的劳动合同期限短于任期的,劳动合同期限自动延长至任期期满。但是,在任职期间本人有严重过失或者达到法定退休年龄的除外。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">工会主席、副主席任期未满,公司不得随意变更其工作岗位或者调动其工作。因工作需要变更工作岗位或者调动时,应当事先征得本级工会委员会和上一级工会的同意。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">第三章 劳动报酬</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十五条 公司工资分配制度</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司以岗位责任、劳动绩效、经营风险为主要依据,制定工资分配制度,严格执行国家最低工资保障制度,以及国家劳动法律有关工资及职工福利制度。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司工资分配制度遵循同工同酬、注重知识与技能、多劳多得、合法合规的原则,使工资与责任、利益和风险挂钩。其内容包括职工工资分配原则、方式以及工资、奖金、津贴和补贴等具体分配办法等,确保制度透明。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司在制定和调整工资分配制度、考核分配制度等涉及职工权益的方案及实施办法时,应与工会进行平等集体协商,其方案须经职工代表大会或职工大会审议通过后实施。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十六条 工资制度</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司因生产特点需要不能实行标准工时制的,可以实行综合计算工时工作制,即分别以周、月、季、年等为周期,综合计算工作时间,但其平均日工作时间和平均周工作时间应与法定标准工作时间基本相同,超出部分应支付延长工作时间劳动报酬。公司实行综合计算工时工作制须报劳动行政部门审批后方可执行,并告知工会。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)平均每天工作超过8小时以上的时间,平均每周工作超过40小时以上的时间,在法定休息日、节假日安排职工工作的时间,为加班时间。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)公司应严格控制加班时间。一般每日不得超过1小时;因特殊原因,在保障职工身体健康的条件下每日不得超过3小时,但是每月不得超过36小时。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)公司与工会和职工代表协商,确定加班工作时间、人员和内容。如果公司未与工会和职工代表协商,强迫职工加班加点,职工则有权拒绝。职工本人需要加班的,应征得主管部门审批,方能获得加班工资。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)工会可以随时查阅公司加班情况的记录,并检查职工倒休、加班工资的落实情况。对有损于职工身体健康和人身安全、超过法定延长工作时间或制度性延长工作时间的行为,工会有权代表职工予以制止,并向公司和上级主管部门反映。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)自然灾害、公用设施维护紧急处理或完成政府下达的紧急任务等情况需要加班,不受上述条款限制,职工应服从安排。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(六)公司按照规定应该安排补休的,应当在 个工作日内安排职工休息;无法安排职工补休的,发放加班工资。职工可以根据自身需要提出补休时间,如果职工申请补休的要求被公司拒绝,可以继续保留这些补休时间一年有效</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)职工每周至少有一天的休息日。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)职工各种假期遇国家法定休假日自动顺延。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)职工依法享受病假、婚假、丧假、产假、计划生育假、探亲假、工伤假等假期。休假期间的工资按照公司考核规定发放。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)跨省市探亲假的往返路费报销,国家已有规定的按规定办理;未作规定的,公司根据情况,酌情报销 style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)公司于每年1月份,向全体职工公布本年度带薪年休假选择时间段、职工本人的年休假天数、提交申请的截止日期等,由职工本人自主选择休假时间,并向公司或工会提交休假的书面申请。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)公司和工会根据实际情况,共同做出本年度的职工年休假计划,并贴出布告,公布每名职工本年度的休假安排。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)由于特殊情况,职工不能按原计划休假,或由于特殊情况临时需要调整计划,职工应提前日向企业和工会提出申请,由企业和工会共同协商,并于日内做出答复。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)所有事先公布的休假安排必须严格履行。</span></p> 劳动安全与卫生</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十七条 公司根据国家有关法律法规规定,按照《安全生产法》、《职业病防治法》、《工会法》对安全生产的规定要求,依法履行安全生产管理,建立安全生产长效机制,保障职工的生命安全与身体健康。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司必须提供符合国家有关安全生产法律、法规规定和国家标准或者行业标准要求的生产经营场所、设备、设施。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司设立专项安全生产监督管理保障经费,确保安全生产工作的开展。按规定比例提取安全环保费用,用于改善劳动条件和增强职工安全意识,防止事故,减少职业危害。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十八条 公司应加强和改善劳动安全卫生条件、劳动防护以及特殊工种和女职工的特殊保护工作。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">工会支持公司加强劳动保护管理,配合检查、监督劳动保护情况。工会应支持公司对危及公司和职工安全的行为进行惩处。工会发现公司领导违章指挥、强令职工冒险作业,或生产过程中发现明显重大事故隐患、职业危害和危及职工生命安全时,有权提出解决建议;有权向公司建议组织职工撤离危险现场,公司必须及时做出处理决定。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十九条 公司应提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品。对有毒有害作业岗位的职工发放保健津贴和劳动保护用品;发放标准按照不同的作业场所和作业岗位的保健津贴标准,每月按时发放。针对不同作业工种和作业环境设立必要的劳动作业休息场所;按时发放符合劳动卫生标准的劳动保护用品。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十条 对从事接触职业病危害作业的职工,公司应当按照国务院卫生行政部门的规定组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果如实告知职工。职业健康检查费用由公司承担。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司对从事有职业危害作业的职工每年一次进行专项健康体检。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十一条 公司发生生产安全事故后,事故现场有关人员应当立即报告公司负责人。公司应及时通知工会,工会有权依法参加事故调查,向有关部门提出处理意见,并要求追究有关责任人员的责任。</span></p> <p class="Normal"><span 公司和工会有责任教育职工严格遵守各项生产规章制度及操作规程,教育和组织职工接受安全技术培训和管理。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">公司对新入厂的职工进行安全教育;对从事特种作业(以国家规定工种范围为准)的人员必须进行岗前培训,经考试合格后,持证上岗。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">工会积极配合公司对职工进行各项安全教育培训工作,提高职工的技术素质和安全意识,建立安全生产宣传教育制度,组织开展好“安康杯”竞赛活动和“安全生产月”活动,开展形式多样的安全生产宣传教育活动。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第四十三条 公司应建立工会劳动保护监督检查委员会,生产班组中设立工会小组劳动保护检查员;应建立职工代表大会或职工大会监督安全生产工作制度,公司法定代表人每年至少一次向职代会报告安全生产情况等。</span></p> <p class="Heading-3"><span 公司依据《妇女权益保障法》和政府关于女职工劳动保护的相关政策法规,实施女职工劳动保护。严格执行劳动部颁发的《女职工禁忌劳动范围规定》,把女职工劳动安全与健康保护纳入职业安全健康管理体系,同步实施。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)对从事高处、低温、冷水作业和国家规定的第三级体力劳动强度作业的女职工,在月经期间,公司应暂时减少工作量或调整岗位。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)不得安排怀孕女职工在35℃以上的高温天气露天作业以及温度在33℃以上的工作场所作业。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)女职工怀孕7个月以上早产或者超期分娩的,按正常分娩对待。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)产假期满,公司应恢复女职工原岗位工作,并给予</span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)女职工产后假满仍需治疗的,经医疗机构证明,按国家规定的疾病医疗待遇办理。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)女职工实施计划生育的费用按规定报销,并根据医生建议给予休息,休息时间视为劳动时间。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)违反计划生育规定的,不享受生育期间的经济待遇。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十四条 女职工哺乳期保护</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)领取《独生子女父母光荣证》的女职工产假期满后,经批准,可以再增加产假三个月(需减免三年独生子女父母奖励费)。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)经市或区、县级医疗单位确诊为体弱儿的,应适当延长哺乳时间,但最多不超过6个月。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)对哺乳不满1周岁婴儿的女职工,因特殊原因确实不能保证其每天哺乳时间的,在自愿的前提下,可以集中使用哺乳时间,并算作劳动时间。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)特殊情况下,公司与职工协商一致,可以休产假延长假,延长假最多不能超过哺乳期,延长假期间,工资待遇不得低于公司最低工资标准。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十五条 女职工更年期保护</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">经区、县(含区、县)以上综合医疗机构或妇幼保健机构诊断为更年期综合症,经治疗效果仍不明显,且不适应原工作的女职工,公司适当减轻其工作量或者暂时安排其他适合的工作。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十六条 公司执行《北京市企业职工生育保险规定》</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">女职工由于计划生育手术、生育或流产,经本人申请并提供相关的医疗证明后,公司按规定向社会保险经办机构申报生育津贴以及报销产前检查、计划生育手术门诊医疗费用。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">生育津贴按照女职工本人生育当月的缴费基数除以30再乘以产假天数计算。生育津贴为女职工产假期间的工资,生育津贴低于本人工资标准的,差额部分由公司补足。</span></p> 公司按照《北京市人口与计划生育条例》规定发放独生子女父母奖励费,每月为10元。独生子女的托幼管理费由夫妻双方所在单位依照有关规定报销。职工子女十八周岁之前的医药费,参加市统一医疗保险后自付部分公司报销  %。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)三八妇女节期间,公司安排女职工上班的,应给予女职工不低于4小时的加班工资。</span></p> 规章制度与奖惩</span></p> <p class="Normal"><span 公司在制定、修改或者决定有关劳动报酬、工作时间、休息休假、劳动安全卫生、保险福利、职工培训、劳动纪律以及劳动定额管理等直接涉及劳动者切身利益的规章制度或者重大事项时,应当经职工代表大会或者全体职工讨论,提出方案和意见,与工会或者职工代表平等协商确定。</span></p> <p class="Normal"><span 职工应严格遵守企业劳动纪律和各项规章制度,努力做好本职工作。公司对为社会和公司做出突出贡献的职工,应给予物质奖励和精神鼓励;公司对违纪、工作有较大失误、失职以及犯有其他严重错误的职工,应依照规定给予相应处理。具体实施办法由公司与工会协商确定。</span></p> <p class="Normal"><span 公司应成立劳动竞赛委员会,对劳动竞赛活动进行统一领导。工会组织职工开展劳动竞赛、合理化建议、技术革新、技术攻关、技术协作、发明创造、岗位练兵、技术比赛等群众性经济技术创新活动。公司应支持工会开展的群众性经济技术创新活动,为开展活动创造条件。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)双方协商代表对原集体合同内容进行协商,进行相应的修改和补充,形成新的集体合同草案。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)按照签订集体合同程序,履行续订集体合同手续。</span></p> style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">第十三章 履行集体合同发生争议的处理</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:Arial;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第七十五条 因履行本合同发生争议时,双方应本着平等协商、合作的原则解决。一方首席代表提议协商处理时,双方应在</span><span 协商不能达成一致意见时,职工一方可自集体争议发生之日起60日内向公司工商注册地所属  劳动争议仲裁委员会申请仲裁。</span></p> <p class="Normal"><span 对仲裁裁决不服的一方,可以自收到《仲裁裁决书》之日起15日内向公司工商注册地所属人民法院提起诉讼。期满不起诉的,《仲裁裁决书》发生法律效力。</span></p> <p class="Normal"><span 公司违反集体合同,侵犯职工劳动权益的,工会可以依法要求公司承担责任;因履行集体合同发生争议,经协商解决不成的,工会可以依法申请仲裁、提起诉讼。</span></p> <p class="Heading-3"><span
