style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)实行标准工时工作制度的,甲方安排乙方每日工作时间不超过8小时,每周不超过40小时。甲方由于工作需要,经与乙方协商后可以延长工作时间,一般每日不得超过1小时,因特殊原因需要延长工作时间的,在保障乙方身体健康的条件下延长工作时间不得超过3小时,每月不得超过36小时。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)实行综合计算工时工作制的,平均每日工作时间不超过8小时,平均每周工作时间不得超过40小时。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)实行不定时工作制的,工作时间和休息休假由乙方自行安排。</span></p> 甲方安排乙方延长工作时间,或因需要在法定节假日工作的,应安排相应的补休时间,如不能安排补休的,按照《劳动法》第四十四条规定,支付劳动报酬,所需费用由甲方承担。</span></p> <p class="Normal"><span 乙方在合同期内享有国家和自治区规定的各项休息、休假、产假的权利,甲方应保证乙方每周至少休息1天。</span></p> <p class="Heading-3"><span 甲方必须执行国家和自治区有关劳动安全卫生的法规标准,采取劳动保护措施,提供和改善劳动条件,保证安全生产和劳动者健康。</span></p> <p class="Normal"><span 甲方应对乙方进行必要的上岗前教育,对专业性、技术性较强的岗位,应会同劳动就业服务机构进行岗位培训,并经地(市)及其以上人力资源和社会保障行政部门考核合格后方可上岗。</span></p> <p class="Normal"><span 甲方应按国家有关规定,不得安排女职工从事禁忌的劳动和工作岗位。</span></p> <p class="Heading-3"><span 甲方应以法定货币形式按月于每月</span><span 甲方依法制定的各项规章制度应向乙方公示。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十七条 乙方应严格遵守甲方制定的规章制度,完成工作任务,提高职业技能,执行劳动安全卫生规程,遵守劳动纪律和职业道德。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十八条 乙方违反劳动纪律,甲方可依据本单位规章制度,给予纪律处分,直至解除本合同。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">八、劳动合同变更、解除、终止、续订</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第十九条 经甲乙双方协商一致,可以变更本合同约定的相关内容。变更劳动合同,应当采用书面形式。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十条 经甲乙双方协商一致,本合同可以解除。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十一条 乙方提前三十日以书面形式通知甲方,可以解除劳动合同。乙方在试用期内提前三日通知甲方,可以解除劳动合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十二条 甲方有下列情形之一的,乙方可以解除劳动合同:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)未按照劳动合同约定提供劳动保护或者劳动条件的;</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)未及时足额支付劳动报酬的;</span></p> <p style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)未依法为乙方缴纳社会保险费的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)甲方的规章制度违反法律、法规的规定,损害乙方权益的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)因《劳动合同法》第二十六条第一款规定的情形致使劳动合同无效的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(六)法律、行政法规规定乙方可以解除劳动合同的其他情形。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十三条 乙方有下列情形之一的,甲方可以解除本合同。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)在试用期间,被证明不符合聘用条件的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)严重违反甲方的规章制度的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)严重失职、营私舞弊,对甲方利益造成重大损害的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)乙方同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经甲方提出,拒不改正的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十四条 有下列情形之一,甲方提前三十日以书面形式通知乙方本人或者额外支付乙方一个月工资后,可以解除劳动合同:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)乙方患病或非因工负伤,在医疗期满后不能从事原工作,也不能从事甲方另行安排的其他工作的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行的,经甲方与乙方协商,未能就变更劳动合同内容达成协议的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十五条 乙方有下列情形之一的,甲方不得依照本合同第二十四条的规定解除劳动合同:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)在本单位患职业病或者因工负伤被鉴定为一级至四级伤残的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)患职业病或者因工负伤,在停工留薪内的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)女职工在孕期、产期、哺乳期的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)距自治区规定退休年龄不足5年(含5年)的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)法律、行政法规规定的其他情形。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十六条 有下列情形之一的,劳动合同终止:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)劳动合同期满的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)乙方开始依法享受基本养老保险待遇的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)乙方死亡,或者被人民法院宣告死亡或者宣告失踪的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)甲方因公益性岗位消失的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)经年度考核被评定为不称职的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(六)法律、行政法规规定的其他情形的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十七条 在劳动合同期内符合下列条件之一的,应退出公益性岗位:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)通过招考,被录用为公务员或事业单位工作人员的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)具备一定专业技能和工作经验,在编制范围内被用人单位录用为劳动合同制工人的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)通过其他合法途径实现就业并取得稳定收入的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)在工商行政管理部门实名注册从事经营活动的,或者通过小额担保贷款从事经营活动的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)户口迁出公益性岗位所在地的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(六)参军入伍、考入大中专学校的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(七)因情况发生变化,不再符合就业困难人员认定条件的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十八条 甲方有下列情形之一的,给乙方造成损害的,应当承担赔偿责任:</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)以暴力、威胁或者非法限制人身自由的手段强迫劳动的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)违章指挥或者强令冒险作业危及乙方人身安全的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)侮辱、体罚、殴打、非法搜查或者拘禁乙方的;</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)劳动条例恶劣、环境污染严重,给乙方身心健康造成严重损害的。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第二十九条 公益性岗位从业人员解除终止劳动合同,不适用《劳动合同法》有关无固定期限劳动合同的规定以及付经济补偿的规定。</span></p> <p class="Heading-3"><span style="color:#000000;font-size:13.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;font-weight:bold;">九、劳动争议处理</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">双方履行本合同如发生争议,可先行协商解决;不愿协商或协商不成的,可在争议发生之日起1年内向所在地劳动人事争议仲裁委员会申请仲裁;其他双方需协商的事项:</span><span
