style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;text-decoration: underline;"> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">三、甲方依照《城市商品房预售管理办法》、《浙江省商品房预售资金监管暂行办法》等规定,负责实施对本协议确定的上述监管项目预售资金的收存和使用的日常监督管理工作。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">四、甲方应当做好金融服务工作,方便乙方和购房人办理预售资金存转业务和按揭贷款、结算等手续。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">五、乙方在甲方开立资金账户,作为监管项目商品房预售资金的唯一专用存款账户。商品房预售的购房款(包括首付款、分期付款、一次性付款等)由购房人直接存入该资金账户,房地产开发企业不得擅自收存;各银行机构发放的按揭贷款、住房公积金贷款必须直接划入上述资金账户内,不得直接支付给乙方或者转作他用。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">六、乙方必须根据有关规定,接受对商品房预售资金的监督管理,保障购房人的合法权益,并按照《商品房买卖合同》约定的时间和要求,将竣工验收合格的商品房交付给购房人。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">七、乙方与购房人签订《商品房买卖合同》后</span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;text-decoration: underline;"> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">八、乙方根据规定程序向购房人退还预售资金的,应当按照本协议的约定由甲方进行审核、确认。如《商品房买卖合同》已经办理预售备案登记的,甲方应当凭乙方提交的撤销预售备案登记资料办理退款手续;如《商品房买卖合同》未办理预售备案登记的,甲方应当凭原签订的《商品房买卖合同》、预售资金存入资金账户证明以及乙方与购房人签订的终止合同办理退款手续。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">九、丙方应在每月月末出具工程实际进度或者已完成投资额证明。如乙方提出申请,丙方应在三个工作日内为乙方出具工程实际进度或者完成投资额证明。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">十、甲方应当根据丙方出具的工程实际进度或者完成投资额证明,以及乙方提供的监管项目其他有效资金支出证明材料,按监管项目实际支出需要拨付资金。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">十一、乙方经甲方核准使用的预售资金,只能用于支付监管项目开发建设需要。资金账户中累计商品房预售资金不低于监管项目工程预算清册总额的130%部分纳入本协议监管。其中,监管项目工程预算清册总额的20%可以用于监管项目相应的前期工程费、管理费、销售费、财务费、不可预见费、税费、同步归还本项目房地产开发贷款及其他费用。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">十二、违约责任</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)因丙方未按照本协议约定履行职责,造成监管资金未能使用于项目建设,致使本协议项下的项目建设不能按期竣工,给购房人造成损害的,丙方与乙方承担连带赔偿责任。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)丙方无正当理由逾期审查乙方提出的用款申请材料,造成项目建设延误的,由丙方按照乙方所受经济损失的</span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;text-decoration: underline;"> class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)因甲方未尽责履行监管义务,致使本协议项下的项目无法正常建设,给购房人造成损失的,甲方与乙方应当承担连带赔偿责任。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)因甲方无正当理由克扣或者迟延支付乙方所需工程款项,给乙方造成损失的,甲方应当承担赔偿责任。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)因丙方未认真审核或者甲方未提供监管资金余额的准确情况,造成本协议项下的项目建设不能按期竣工,给购房人造成损失的,甲、乙、丙三方应当承担连带赔偿责任,但有证据证明甲、丙两方无过错的除外。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">十三、争议解决方式</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">本协议在履行过程中发生争议的,由三方当事人协商解决,协商不成的,可以要求监管项目所在地房地产行政主管部门和金融管理部门共同调解,协商或者调解不成,或者当事人不愿调解的,按照下列第</span><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;text-decoration: underline;"> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">本协议项下监管项目竣工验收备案后,根据房地产行政主管部门出具的相关证明和乙方提出的资金账户撤销申请,经协议三方一致书面同意,资金账户内的商品房预售资金方可解除监管,同时本协议终止。乙方应当及时将预售资金监管撤销情况报当地房地产行政主管部门备案。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">如本协议在履行期满前确需提前终止的,必须由乙方向监管项目所在地房地产行政主管部门申请,经批准并签订新的商品房预售资金监管协议、完成监管资金交割并报当地房地产行政主管部门和人民银行备案后,本协议方可终止履行。</span></p>
