工资支付办法</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">职工患病或者非因工负伤病休期间,当月实发工资在扣除个人应缴纳的各项社会保险及住房公积金后(不含劳模津贴),不得低于企业最低工资标准的80%。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(五)对于超出法定时间并危害职工身心健康的加班,工会有权代表职工向企业和上级主管部门反映。</span></p> 加班约定</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">企业按照国家规定支付加班工资以外,还应遵守下列约定:</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)企业除不可抗力因素和正常安排加班以外,职工在休假日被安排加班,除约定给予补休外,正常计算加班工资;加班时间少于4小时的,应当获得不少于小时加班工资基数4小时的加班工资。</span></p> 用工形式</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)本企业全日制职工。企业与建立劳动关系的所有人员签订劳动合同,并依据劳动合同确定的工作岗位、内容、时间、标准等安排职工工作。</span></p> 劳动合同的订立</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)企业制定和修改劳动合同时,当事人双方应当就劳动合同的具体内容进行协商,并听取工会的意见。劳动合同文本可以提交职工代表大会或职工大会讨论。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)工会应当向职工宣传与劳动合同相关的法律法规,帮助职工了解文本内容,增强职工履行劳动合同和依法维权的自我保护意识。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)工会对企业劳动合同的管理、签订和履行情况进行监督检查。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(四)企业与女职工签订的劳动合同中不得规定限制女职工结婚、生育等内容。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十八条 劳动合同的变更</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">企业与职工协商一致,可以变更劳动合同约定的内容,并采用书面形式记载,经双方签字或盖章生效。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第三十九条 劳动合同的解除</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(一)企业单方解除劳动合同,应当事先将理由通知工会。工会认为不适当的,有权提出意见。企业违反法律、法规规定或者劳动合同约定的,工会有权要求企业纠正。企业应当研究工会的意见,并将处理结果书面通知工会。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(二)享受医疗期的职工,医疗期满仍未病愈的,应由合肥市劳动能力鉴定委员会进行劳动能力鉴定。被鉴定为一至四级的,应当退出劳动岗位,解除劳动合同,办理因病或非因工负伤病退、退职、退休手续;被鉴定为五至十级的,企业可以解除劳动合同,并按规定支付经济补偿金和医疗补助费。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">(三)国有企业在实施裁员过程中,裁减人员方案应提交职工代表大会审议通过。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">职工在工作时间因工负伤或患职业病需要接受工伤医疗的,可申请工伤假,经医务部门鉴定,负轻伤的,工伤假不超过6个月;负重伤的,工伤假不超过12个月;如伤情严重或情况特殊的,经劳动能力鉴定委员会确认,可适当延长假期,但最多不得延长12个月,除法律法规另有规定外。如果延长12个月后仍因病情未彻底好转需要继续治疗或休养的,职工可考虑病休。</span></p> 劳动安全与卫生</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十三条:企业每年提出年度安全技术措施项目,落实资金,落实责任人员,明确完成时间,组织实施。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">按照国家规定进行新建、扩建、改建和技术改造工程时,对劳动条件和安全卫生设施实行同时设计、同时施工、同时验收投产(即“三同时”审查验收)。在推广新技术、新工艺、新产品时,必须采取可靠的安全卫生措施,并通知工会组织派员参加。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">工会发现企业领导违章指挥、强令职工冒险作业,或生产过程中发现明显重大事故隐患、职业危害和危及职工生命安全时,有权提出解决建议;有权向企业建议组织职工撤离危险现场,企业必须及时做出处理决定。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十五条:企业应根据季节变化,采取具体措施做好防暑降温、防寒保暖工作,按时发放保健用品。夏季高温时期和其他特殊情况下,工会建议减少职工工作时间时,企业应予以考虑。</span></p> style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十六条:企业应提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品。对有毒有害作业岗位的职工发放保健津贴和劳动保护用品;发放标准,按照不同的作业场所和作业岗位的保健津贴标准,每月按时发放。针对不同作业工种和作业环境设立必要的劳动作业休息场所;按时发放符合劳动卫生标准的劳动保护用品。</span></p> <p class="Normal"><span style="color:#000000;font-size:12.0pt;font-family:宋体;mso-fareast-font-family:宋体;mso-bidi-font-family:宋体;lang:EN-US;mso-fareast-language:EN-US;mso-ansi-language:AR-SA;">第五十七条:对从事接触职业病危害作业的职工,企业应当按照国务院卫生行政部门的规定组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果如实告知职工。职业健康检查费用由企业承担。</span></p>
